Description: Witch hazel is a deciduous shrub or small tree which grows in damp woods from Nova Scotia to Georgia and Nebraska; it is also cultivated elsewhere for its autumn-blooming flowers. That said, A witch hazel compress is excellent for treating bruises, minor scrapes and sprains, and as I learned first hand, for reducing swelling and alleviating the pain associated with inflammation. For years and years (more than I care to recall) I worked as a waitress. Somewhere along the way I managed to bang up my ankle and had a cartilage fragment floating about in there wreaking havoc. After a 7 or 8 hour shift on my feet, my ankle would swell to about twice its normal size. I was popping ibuprofen like candy, and hobbling along like a 90 year-old. After a couple of years of this, I finally started searching for an alternative. Lo and behold, there was the witch hazel. After work, I would soak a compress in witch hazel, lay it across my throbbing ankle and within minutes the pain and swelling would start to subside. Within 20 minutes I could walk normally again with little or no discomfort. In contrast, it would take a minimum of 4 to as many as 6 ibuprofen or buffered aspirin and a minimum of 2 hours before I experienced any relief from the discomfort. By Warren R. Shiell Child Support Overview In 1999, over $14 billion was owed to California’s children. 35% of single parent families had income below the poverty line. Statistics show that payment of child support reduces poverty and corresponds to greater involvement by the non-custodial parent in the children’s lives. Do I have to pay child support? Child Support must be paid by a non-custodial parent until the child marries, dies, is emancipated, turns 18 and is not a full time high school student, or turns 19 if they are a full time high school student, whichever occurs first. An adult child who is disabled and unable to earn a living has an ongoing right to support. How much child support should I pay or receive? In California, the courts use a complex mathematical formula to calculate child support that is based on a number of factors such as the gross income of each parent, the percentage of time each parent spends with each child, available tax deductions, child care costs, tax status of each parent and so on. This amount is often referred to as the “guideline” child support amount. Because of the complexity of calculating the “guideline” amount, the Court uses a software program called “Dissomaster.” Most attorneys use this program and will be able to perform child support calculations. The Dissomaster software can be found at www.cflr.com. Any child support order must specify the amount of child support and when it is to be paid. Couples often agree to monthly payments in two installments to coincide with the payor’s bi-weekly receipt of wages. Do the courts ever deviate from the standard formula for child support? The Court may depart from the “guideline” amount in a number of situations set forth in Family Code section 4057 (b). For example, the parent ordered to pay child support may have extraordinary high income and the guideline amount would exceed the needs of the children. Another example would be where the children have special medical or other needs that require an amount greater than the guideline. Can I get my spouse to pay extra for child care and training expenses? There are a number of additional expenses that the non-custodial parent may be required to pay in full or in part. Mandatory add-ons that the Court is required to order include child care costs related to a parent’s employment or training or education for employment and the reasonable uninsured health care costs for the children. Discretionary add-ons include costs related to educational or other special needs of the children and travel expenses for visitation. Generally, the Court will allocate add-ons equally between the parties. However, if the paying parent can prove that this would be unfair, Family Code section 4061(b) provides a procedure for the Court to allocate the payment of add-ons according to the net spendable income of each party. This most often comes into play where one party is also paying spousal support. Who pays for health insurance for the kids? Family Code section 3751 requires the Court, when making a child support order, to order either or both parents to maintain health insurance for the minor children if it is available at no cost or at a reasonable cost. How do I get child support order? Once a petition in a dissolution (divorce) has been filed a parent may request that the Court order temporary child support for children born during the marriage. Where the parents are not married, before the Court can order support, paternity must be established. Since January 1, 1995, all hospitals have been required to provide unmarried parents with the opportunity to voluntarily acknowledge paternity by signing a Voluntary Declaration of Paternity. If this is signed and not rescinded within 60 days it has the same effect as a paternity judgment and can provide the basis for custody, visitation or support. Even if it has not been challenged a motion for genetic testing may still be brought within two years of the child’s birth challenging the Voluntary Declaration of Paternity. Once I’ve gotten a child support order how do I enforce it? In California, every time the Court makes a child support Order it must issue a Wage Assignment Order that directs the payor’s employer to deduct the amount of child support from wages and pay it directly to the payee parent. The wage assignment can be stayed by written agreement of the parties. Can I get help from the County to collect child support? Parents can retain a private attorney to establish and collect support or employ the services of the Department of Child Support Services (DCSS). Unfortunately, Los Angeles County has one of the poorest child collection records in the state and fares poorly when compared to national statistics. What other action can I take to collect child support? If you are owed child support arrears you may request that Court hold the payor parent in contempt. If you can prove that non-payment was knowing and willful, the payor parent can be fined and even jailed. If you are owed child support arrears you may bring an Order To Show Cause requesting that the Court determine the amount of arrearages. You can also petition the Court for a Writ of Execution which can be used against bank accounts. Family Code section 4600 also allows the Court to order the payor parent to deposit up to one year’s child support payments in an interest bearing account as security. This can be used if there’s been a problem receiving child support in the past or if the payor is self employed. Can I modify a child support order if circumstances change? If you already have a judgment in your case you can find out if the payor’s income has changed by having them served with a Request for Production of an Income and Expense Declaration After Judgment (form FL-396) on the other parent, along with an Income and Expense Declaration (form FL-150) which are available from www.courtinfo.ca.gov/forms/ What are the tax consequences of paying or receiving child support? By Abraham Bruck I have witnessed, both within my own family, in the outside world and in my practice, what can happen in a relationship if there is no common bond that can actually bind a couple together. Well, let me digress (or maybe, progress) and say a bit about getting together as a couple in the first place: even if there is a strong attraction, be it physical, mental or emotional: Love; That does not seem to be enough to keep a couple together; the body will wither, the mind will change and the emotions will flutter. And love may turn into a dependency or habit. Unless, there is a third entity; the glue that binds the one to the other; the bond that binds, a mutual goal and lifetime commitment to it. The it needs to be greater that both of you, a driving force that can take both of you, like a boat down the river, or an ark during a flood (and floods there will be) … In my opinion, there are two good bonds; children and Religion or a Spiritual Practice (to be more politically correct, or any other proven external disciplinary way of life that both parties agreed to commit to whole-heartedly, abide by, follow and emulate; the goal). There are, of course, no guarantees even if both of these are there, but the chances are multiplied exponentially. Without these, there is no common bond; it’s just two people living separate lives together: convenient for a nice meal, some ambiance, safe sex, and the occasional meaningful conversation … So, the intent or lifetime goal of both parties must be the same. Otherwise, both sides will be resentful, because, in any situation, for any important decision, no compromise can satisfy both of the parties, because their primary motivating goals are different; or they have no primary motivating goals and just dont feel like it at the time. And so there is no improvement in the situation and resentments, anger, etc. build; and there is no possibility for a long-term relationship. Love may sometimes seem to be obscured by a tendency towards negativity, insecurity and fear/anxiety. But this is who the person is at the moment; and they are perfect the way they are. Love may sometimes seem to be obscured by a tendency towards not wanting to be so depended upon by the other, for their happiness, security and emotional wellbeing. But this is who that person is at the moment; and perfect the way they are. Much of this may stem from residual family entanglements. Some behaviors may come from family control issues. Some behaviors may come from family insecurity issues. There are a few key issues that need to be kept in mind: Trust! Honesty! One must trust the other, as the right hand trusts the left. And one must be honest and trustworthy, inside the relationship and in the world at large as well; trusting yourself, being honest with yourself and trusting your partner and being honest with your partner, and being trustworthy and honest in all your dealings in the world. In other words, your thoughts, speech and actions should always be in line with a clear conscience. There are times when you will feel rejected or abandoned, based on your perception of the situation. There is usually no reason to feel this way; from the others standpoint, it’s not about you, it may be about their family control issues. At times you may feel that you would appear weak if you give in to the desires of the other. There is no reason to feel weak by giving in: remember the bond that binds; you can show your compassion and accommodation of what may be the others family insecurity issues. Besides the above mentioned, or perhaps, because of the above mentioned, there may be a lack of real compassion and empathy on the part of both parties for each other. To see the world from the other persons heart and to trust the other person, that they are doing the best they can. To see them as perfect, the way they are. (That’s not to say that there is no room for improvement.) To realize the person is always more important than any ideology or material object or goal; the relationship comes first. Perhaps ask; what’s the worst thing that can happen if the worst thing happens. Usually the answer is not such a big deal. Again, the third entity, the bond that binds, the trust in that everything that happens is only good. There is a need for genuine compassion and complete acceptance of the other as perfect as they are; acknowledgment and acceptance of each others needs and idiosyncrasies and the commitment and willingness to live with them as they are, for as long as they are that way. Which, if you ask me, and as has been proven millions of times in the present and throughout history, cannot be accomplished without the “third party”, the bond that binds one love to the other. The other person; their feelings, hopes, dreams, goals must be your own as well: you are one; heads and tails of the same coin. One person, soul, living life in two bodies. It says, All beginnings are difficult.
